Terms and Conditions<\/h1>\n

Definitions<\/h3>\n

Buyer<\/strong>: Any natural person (adult) or legal entity.<\/p>\n

Seller<\/strong>: Hobby Robotics Armenia store.<\/p>\n

Courier<\/strong>: A person authorized by the Hobby Robotics Armenia store who delivers the ordered Product to the Buyer at the location specified by the latter.<\/p>\n

Order<\/strong>: A request by any natural person or legal entity to deliver\/ship any product presented for sale on the hobbyrobotics.am<\/a> website upon purchase.<\/p>\n

Delivery<\/strong>: The act of delivering any product presented for sale on the hobbyrobotics.am<\/a> website to the Buyer through the Seller and\/or a person authorized by the Seller upon purchase by any natural person or legal entity.<\/p>\n

1. General Provisions<\/h3>\n

1.1 Hobby Robotics Armenia store welcomes you to the hobbyrobotics.am<\/a> website and suggests that you familiarize yourself with the terms and conditions below before agreeing to purchase any preferred product.<\/p>\n

1.2 On this website, Hobby Robotics Armenia store (hereinafter also referred to as the Seller) presents the products it sells, which constitutes a public offer addressed to all natural persons and legal entities who have the right to conclude a Product purchase\/sale Agreement with the Seller under the conditions defined in the offer. The agreement concluded based on the Buyer’s acceptance of this offer is an adhesion contract, which the Buyer joins without any exceptions and\/or objections. <\/p>\n

1.3 The placement of a Product purchase order by the Buyer, whether independently or through the Seller, constitutes an undeniable fact of acceptance of these terms. A Buyer who has confirmed a Product purchase order is considered a person who has entered into a relationship with the seller under these terms and conditions. <\/p>\n

1.4 In the event of the absence of the ordered Product(s) at the Seller’s location, the Seller has the right to completely or partially cancel the Buyer’s order, of which the Seller will inform the Buyer by sending an email to the latter’s email address (specified during Order confirmation) or via telephone (or any other means of telecommunication), if such a possibility exists.<\/p>\n

2. Subject of Purchase and Payment Procedure for Products<\/h3>\n

2.1 The Seller transfers based on a registered valid\/active order, and the Buyer, after confirming the order, pays for and receives the ordered Product in accordance with this agreement.<\/p>\n

2.2 The price of the Product is set by the Seller unilaterally (previously published on the hobbyrobotics.am<\/a> website) and is set in Armenian Drams, representing the value\/price of one unit of the Product.<\/p>\n

2.3 The Seller has the right to change the price of the offered products at any time without notice.<\/p>\n

2.4 The price of the product is paid by the Buyer in full (100%) and as a lump sum. The Buyer may choose to pay for the product either in cash or by non-cash means via transfer to the Seller’s bank account. The Buyer must inform the Seller in advance of their choice regarding the payment method. <\/p>\n

2.4.1 Payment options for Products.<\/p>\n

The buyer can pay for the Products in cash or non-cash using one of the following options:<\/p>\n

2.4.1.1 Cash payment options and procedure<\/p>\n

If the Buyer chooses the cash payment option, the cash payment is made at the time of handing over the Product to the Buyer through the Courier or at the store upon the Seller handing over the Product to the Buyer. The fact of payment for the Product is confirmed by a sales receipt given to the Buyer. The Seller urges you to keep the sales receipt. <\/p>\n

2.4.1.2 Non-cash payment options and procedure<\/p>\n

The Buyer can pay via:<\/p>\n

– Bank cards issued by RA and international banks,<\/p>\n

– Electronic wallets cooperating with the store,<\/p>\n

– Transfer to the Seller’s bank account,<\/p>\n

– Built-in payment tools of the hobbyrobotics.am<\/a> online store,<\/p>\n

– Other previously mutually agreed methods.<\/p>\n

3. Acceptance of Orders, Terms and Procedure for Product Delivery or Handover<\/h3>\n

The Seller’s obligations toward the Buyer are considered fully performed from the moment the product is handed over to the Buyer.<\/span><\/p>\n

3.1.1 Products can be purchased at the store by:<\/p>\n

– Visiting without a prior appointment and paying via one of the options mentioned in point 2.4.1,<\/p>\n

– By pre-ordering on the hobbyrobotics.am<\/a> website, selecting the “Pick up in store”<\/em><\/strong> option as the delivery method, and paying via one of the options mentioned in point 2.4.1. When choosing the “Pay in store”<\/strong><\/em> option for the order, the order will be held for 2 days. <\/p>\n

– By pre-ordering via a call to the contact phone number listed on the “Contact Us”<\/em><\/strong> page, with payment via one of the options mentioned in point 2.4.1. In case of agreement to pay for the order at the time of picking up the product from the store<\/span><\/span><\/span>, the order will be held for 2 days. <\/p>\n

3.1.2 Products are purchased via Delivery by:<\/p>\n

– By pre-ordering through the hobbyrobotics.am<\/a> website, selecting either the “Delivery via courier”<\/strong><\/em> or “Postal delivery”<\/strong><\/em> options as the delivery method, and paying via one of the options mentioned in point 2.4.1.<\/p>\n

– By ordering via a call to the contact phone number listed on the “Contact Us”<\/em><\/strong> page, with payment via one of the options mentioned in point 2.4.1.<\/p>\n

3.2 The “Delivery via courier”<\/strong><\/em> option is available <\/span>within Yerevan and up to a distance of 60km from the store’s location. Delivery is carried out via couriers within 1 day (including non-working days). Before organizing the delivery, a store employee contacts the Buyer to clarify the delivery terms (including the specific day, time, and location of delivery) and the Buyer’s readiness to receive the shipment at that time. In case of inability to contact the Buyer using the contact details provided by the Buyer and available to the Seller, the Seller is released from responsibility for any delay in organizing the delivery. If the Buyer is absent from the specified location at the pre-arranged time, or if the courier is unable to contact the Buyer using the contact details available to the Seller, the shipment will be returned to the store and can only be redelivered upon double payment for delivery. Moreover, if the delivery was organized for free based on the conditions below, the cost of redelivery will be calculated according to the paid delivery terms.<\/span><\/span><\/p>\n

Within Yerevan, delivery via the “Delivery via courier” option <\/strong><\/em>costs 1,000 AMD if the total order value does not exceed 20,000 AMD, and is free if the total order value exceeds 20,000 AMD.
\nOn the outskirts of Yerevan and outside the city, up to 60km from the store’s location, the cost of delivery via the “Delivery via courier”<\/strong><\/em> option is calculated automatically by the system on the checkout page, depending on the delivery address.<\/span><\/p>\n

3.3 The “Postal delivery” <\/strong><\/em><\/span>option is available <\/span>for the entire territory of the Republic of Armenia<\/strong>. The shipment is handed over to the post office within 1 working day and reaches the Buyer within the timeframes set by “HayPost” CJSC (details at www.haypost.am).<\/span><\/span><\/p>\n

If the total order value does not exceed 20,000 AMD, the cost of delivery via the “Postal delivery” <\/strong><\/em>option is calculated automatically by the system on the checkout page, depending on the delivery address, based on the standards set by “HayPost” CJSC.
\nIf the total order value exceeds 20,000 AMD, delivery via the “Postal delivery” <\/strong><\/em>option is carried out free of charge throughout the entire territory of the Republic of Armenia.<\/strong>
\n<\/span><\/p>\n

3.3 The Seller does not deliver products to places of imprisonment, military units, hotels, public catering facilities, cafes, airports, metro stations, and other similar public places, as well as any place that is not considered the permanent residence, work, or location of the customer.<\/p>\n

3.4 The Seller is not responsible for the terms set for Delivery, specifically for failure to deliver the product within the set timeframe, if these arose due to the Buyer’s fault\u2014i.e., incorrectly specified delivery address, absence from the specified address, or not residing there\u2014as well as due to circumstances beyond the Seller’s control, such as impossibility caused by a natural disaster, accident, or other force majeure.<\/p>\n

3.5 The Buyer’s right of ownership over the ordered Product arises from the moment of actual payment of the price\/value set for the Product. From the moment the Seller hands over the product to the Buyer, the risk of destruction or damage to the Product passes to the Buyer. <\/p>\n

3.7 In specific cases, it may be necessary to identify the Buyer. In such cases, at the Courier’s request, the Buyer is obliged to provide the necessary information or documents to the Courier. If the Buyer refuses the specified procedure, the Courier has the right not to hand over the delivered product to the Buyer. <\/p>\n

4.1 Rights and Obligations of the Parties<\/h3>\n

The Seller undertakes to:<\/strong><\/p>\n

4.1.1 Fulfill its obligations to the Buyer in accordance with these Terms and the current legislation of the Republic of Armenia.<\/p>\n

4.1.2 In the event of a change in the Delivery terms of the ordered Product, inform the Buyer as soon as possible about the full or partial change in the Order Delivery conditions to obtain the latter’s consent regarding the changed conditions. The Seller contacts the Buyer via telephone or email. <\/p>\n

The Seller has the right to:<\/p>\n

4.2.1 Unilaterally change these Terms and Conditions at any time, including the price of the Product, payment types and terms, and Product Delivery. All changes take effect from the moment they are published on the website, and the fact of publishing these (changes) serves as proof that the Buyer is informed of the changes made. <\/p>\n

4.2.2 Not accept complaints related to the quality of the Product if the Product’s merchantable appearance, storage conditions, or consumer properties have not been maintained, and\/or in cases where the Product’s defects arose due to the Buyer’s negligence or violation of the Product’s operating conditions set by the manufacturer, or if the defects arose as a result of any type of external influence on the Product.<\/p>\n

4.2.3 Not deliver the ordered Product or demand the return of an already delivered\/shipped Product from the Buyer if the price set for it has not been paid or has been paid incompletely (improperly).<\/p>\n

The Buyer is obliged to:<\/p>\n

4.3.1 Before the transaction, familiarize themselves in detail with the content of these Terms and the conditions set therein, as well as the prices set for the Products sold on the hobbyrobotics.am<\/a> website.<\/p>\n

4.3.2 For the purpose of the Seller fulfilling its obligations to the Buyer, the Buyer is obliged to provide the Seller with a clear and correct address and other data as necessary for the delivery (shipping) of the ordered Product.<\/p>\n

4.3.3 Pay the price indicated on the hobbyrobotics.am<\/a> website for the ordered Product in accordance with these terms.<\/p>\n

5. Return of the Product or the Amount Paid for It<\/h3>\n

5.1 In the event of a dispute between the Parties regarding the return of the Product or the amount paid for the Product, the Parties are guided by these Terms, the Civil Code of the Republic of Armenia, the RA Law “On Protection of Consumer Rights,” the RA Government Decision “N 140 of February 18, 2002,” and other normative legal acts regulating the legal relations between the Buyer and the Seller.<\/p>\n

5.2 In any case, the Seller may refuse to take back, exchange, or refund the paid amount and not accept the returned Product if the Product’s merchantable appearance or consumer properties are not maintained, or if the Product is presented in a damaged state resulting from external influence. At the same time, the product must be new, must have its protective films intact, and must not contain (either in appearance or in its internal content and properties) traces of use. Furthermore, the Product’s container and packaging must also be undamaged. The provisions defined in this point also apply to the elements contained in the set of the Product (and\/or products). <\/p>\n

5.4 The Buyer submits their requests to the Seller in writing, to which a written response is given as soon as possible during working days. Moreover, the Buyer’s requests will be subject to discussion if the Buyer presents a document certifying the fact of purchasing the Product from the Seller (at least a sales receipt). <\/p>\n

6. Dispute Resolution Procedure<\/h3>\n

6.1 In the event of a dispute between the Parties, the dispute shall be resolved through negotiations, and in cases where the dispute is not resolved as a result of negotiations, the Parties may apply to the court to resolve the dispute. The resolution of disputes shall be submitted to the courts operating in the territory of the Republic of Armenia. <\/p>\n

7. Force Majeure \/ Impact of Irresistible Force<\/h3>\n

7.1 In the event of full or partial failure to perform obligations under these terms, the Parties are exempt from liability if this was the result of the impact of an irresistible force that arose after the transaction, which the Parties could not have predicted or prevented. Such situations include earthquakes, floods, war, declaration of martial law or a state of emergency, cessation of communication means, acts of state bodies, etc., which make the fulfillment of the assumed obligations impossible. If the impact of the irresistible force continues for more than 3 (three) months, each of the Parties has the right to renounce the obligations assumed by them, informing the other party in writing in advance.<\/p>\n

8. Confidentiality and Protection of Personal Data<\/h3>\n

8.1When placing an Order on the hobbyrobotics.am<\/a> website, the Buyer provides the following information about themselves: first name, last name, name of the organization or Sole Proprietorship, TIN (HVHH), phone number, email address, registration address, and actual residence address (if the registration address differs from the residence address) where the ordered Product should be delivered.<\/p>\n

8.2 The Seller uses the information received from the Buyer to fulfill the obligations acquired toward the Buyer.<\/p>\n

8.3 The Seller undertakes not to disclose the data received from the Buyer, except for cases defined by these Terms and the law. The Seller may transfer such data to agents and third parties acting on the basis of an agreement with the Seller for the purpose of fulfilling the obligations assumed toward the Buyer, for which the Buyer hereby gives their unconditional consent.<\/p>\n

8.4 By accepting these terms, the Buyer gives their permission and consent for the Hobby Robotics Armenia store to process their personal data, including first name, last name, all provided addresses, phone numbers, and email addresses; to carry out the collection, systematization, accumulation, storage, clarification (updating, modification), use, and destruction of personal data, as well as to transfer them to sub-agents for further processing, including collection, systematization, accumulation, storage, clarification (updating, modification), use, and destruction for the purpose of conducting studies aimed at improving service quality, implementing marketing programs, statistical surveys, as well as for promoting its services in the market by establishing direct contact with the Buyer through various means of communication, including but not limited to postal mail, email, phone numbers, fax, and the internet. The Buyer gives their consent and permission for the Hobby Robotics Armenia store and its sub-agents to process the Buyer’s personal data through automated databases, as well as other computer means developed by the Hobby Robotics Armenia store or based on its instructions.<\/p>\n
